Re: Catherine Duffy Petit
Dear Dick:
On January 7, 1994, I met at Looney & Grossman with Cathy Petit, Shirley LeBlanc, Dick Grahn, Ron Caron and Professor David Gregory. During the meeting, you were reached by telephone. As you will recall, you were asked, at the client's insistence, not to communicate with Ralph Lancaster, attorney for Key Bank, John Conner, attorney for the petitioning creditors in Cathy's bankruptcy and Stephen Morrell, attorney for Joseph V. O'Donnell, who claims to he the Trustees-in-Bankruptcy of Catherine Duffy Petit. The request was made, Dick, because of the perception that your communications with these adversary or potentially adversary lawyers was counter-productive. Indeed, your communication to Stephen Morrell resulted in his filing a request for a continuance of the Key Bank case which will only serve to further delay an already unconscionably delayed case.
Notwithstanding the client' s clear instructions, it is my understanding that after January 7, 1994 you communicated with, Stephen Morrell. I must, therefor, repeat in writing the instructions you were given on January 7, 1994 and ask that you net violate the client's instructions by communicating on the subject of Cathy Petit's business with any of Messrs. Lancaster, Conner, O'Donnell or Morrell. If you will now follow the client's instruction in this regard, you will not he blamed for any further damage.
Sincerely,
Stephen F. Gordon
