Dear Joe:

I spoke with John Armando at Pierce, Atwood who reports that at the hearing earlier this week, Cathy Petit was afforded an opportunity to amend her complaint. She has two weeks to do so. Key Bank, then, has two weeks to respond to the amended complaint and the matter will be marked up for disposition on a summary judgement basis shortly thereafter. It would appear as though the matter will remain a Chapter 11 case until sometime this summer. We are going to put our file on the bank shelf in the back room until we hear from you further.
