Re: State of Maine, et al. V. HER Inc., et al., Docket No. CV-96-134
Dear Mrs. Brown:
In addition to my apology on the phone, I wanted to apologize in writing for the couple of off-hand words I uttered in reponse to Judy Dorsey's question to me after I thought you had hung up. Although it was a private comment to a colleague after a long day, and although it was the product of my frustration at what I perceived as a lack of cooperation on your part, nevertheless, it was inappropriate. I regret having given any offense.
As you can see from the enclosed complaint, we have uncovered substantial evidence of fraud as we attempt to help the many people who have expressed to use concern that they may never recover their life savings or retirement monies. As you may have seen, Catherine Petit's counsel now denies that she received any of the millions of dollars raised allegedly to finance the Key Bank litigation. In order to recover money on behalf of investors, we need cooperation from each of our over 80 people who invested over $5,000,000, which simply means a willingness to tell us the facts.
We would like to look forward to your assistance in this matter.
Very truly yours,
Peter J. Brann
Assistant Attorney General
